Buyer & Seller Terms
These terms govern the relationship between buyers, sellers, and Bidding Fever. By participating in any auction on our platform, you agree to these terms.
Last updated: March 2026
All bids on Bidding Fever are legally binding. Please read these terms carefully before participating in any auction.
Buyer Terms
Bidding Obligations
All bids placed on Bidding Fever are legally binding offers to purchase. By placing a bid, you agree to complete the purchase at your bid price plus applicable buyer's premium, taxes, and shipping costs if you are the winning bidder. Bid retractions are not permitted once a bid is placed.
Buyer's Premium
A buyer's premium is added to the hammer price of each lot. The applicable rate is displayed on each auction listing before you bid. The total cost — including buyer's premium, HST/GST/QST, and any handling or shipping fees — is shown in the cost breakdown before you confirm your bid.
Payment Obligations
Winning bidders must complete payment within the timeframe specified by the auction house (typically 2–5 business days after auction close). Failure to pay may result in the forfeiture of any deposit, suspension of your account, and a non-paying bidder flag on your profile.
Pickup & Shipping
Buyers are responsible for arranging pickup or shipping of won lots as outlined in the auction's shipping terms. Bidding Fever is not responsible for items that are damaged, lost, or unclaimed after the pickup/shipping deadline.
Item Descriptions
All items are sold as described and as-is unless otherwise stated. Buyers are encouraged to review all photographs, condition notes, and lot descriptions carefully before bidding. Bidding Fever does not warranty items listed by sellers.
Registration
Buyers must register and agree to each auction's specific terms before placing their first bid. Some auctions may require phone verification, a refundable deposit, or manual approval before bidding is permitted.
Seller Terms
Accurate Listings
Sellers are responsible for providing accurate, complete, and honest descriptions of all lots. Misrepresentation of items, including condition, provenance, or authenticity, is strictly prohibited and may result in account suspension and liability to buyers.
Pricing & Reserves
Sellers may set reserve prices on individual lots. If a lot does not meet its reserve, the seller is not obligated to sell. Reserve prices are kept confidential but bidders are notified whether or not the reserve has been met.
Platform Fee
The Bidding Fever platform subscription is a flat $149 CAD/month. There are no per-auction or per-lot listing fees. Sellers retain the hammer price minus any payment processing fees charged by Stripe Connect CA.
Auction Conduct
Sellers agree not to bid on their own lots, either directly or through third parties (shill bidding). Violation of this rule will result in immediate account termination and may be reported to relevant authorities.
Settlement
Sellers are responsible for settling won lots with buyers in a timely manner. This includes fulfilling shipping obligations, providing pickup arrangements, and issuing receipts or invoices as required. Bidding Fever provides automated invoice generation to facilitate this process.
Content Ownership
Sellers retain ownership of all content they upload, including photographs and descriptions. By uploading content to Bidding Fever, sellers grant us a non-exclusive, royalty-free license to display that content on the platform for the purpose of facilitating the auction.
Disputes
Bidding Fever provides a dispute resolution system for buyers and sellers. Disputes must be filed within 7 days of the auction closing date. We act as a neutral facilitator — we do not adjudicate disputes or guarantee outcomes. For unresolved disputes, parties may pursue resolution through applicable Canadian provincial consumer protection agencies.
