1. Scope
1.1This policy covers claims that content on Bidding Fever, such as lot photos, descriptions, seller pages or messages, infringes copyright.
1.2It follows Canada's notice-and-notice regime in sections 41.25 to 41.27 of the Copyright Act. It is not the United States notice-and-takedown system. Forwarding a notice under this policy does not, on its own, mean that content is removed.
1.3Separately from forwarding notices, we can remove content that breaks our Terms of Use, as section 5 explains.
2. Where to send a notice
2.1Send copyright notices by email to our designated contact: Copyright notices, 360ISS Inc. (Bidding Fever), Ontario, Canada, privacy@biddingfever.com. Please put "Copyright notice" in the subject line.
2.2We accept notices in French or in English.
3. What a notice must contain
3.1As the Copyright Act requires, your notice must be in writing and state:
- your name and address, and the owner's name if you act for the owner;
- the work or other subject-matter you say is infringed;
- your interest or right in it, for example owner or exclusive licensee;
- where the content is: the web address of the lot, listing or page;
- the infringement you are claiming, meaning how the content infringes your copyright;
- the date and time of the alleged infringement;
- any other information that the regulations under the Copyright Act require.
3.2Under the Copyright Act, a notice must not include an offer to settle, a request or demand for payment or for personal information, or a link to any such offer, request or demand. We do not forward a notice that does.
4. What we do with a notice
4.1When we receive a notice that meets section 3, we forward it electronically, as soon as feasible, to the account holder responsible for the content, usually the seller. We then tell you that we forwarded it or, if we could not, why not.
4.2We keep records that identify the account holder for 6 months after we receive the notice, or for 1 year if, within those 6 months, you tell us that you have started court proceedings about the claimed infringement.
4.3We do not give you the account holder's identity or personal information unless a court orders us to.
4.4We do not charge a fee to forward a notice.
5. Removing content
5.1Separately from forwarding a notice, we may remove or disable content that we believe infringes copyright or otherwise breaks our Terms of Use. We remove content when we learn that a court has decided it infringes copyright.
5.2If your content was removed and you believe that was a mistake, write to privacy@biddingfever.com and explain why. A person reviews every request.
6. Repeat infringers
6.1Our policy is to suspend or close the accounts of users who repeatedly post content that infringes copyright, for example after we have removed their content for infringement more than once, or after a court has found that they infringed.
7. If you receive a forwarded notice
7.1A forwarded notice is the copyright owner's claim, not a finding that you infringed. You do not have to pay anything or reply to the claimant because of it. You may want to get legal advice.
7.2We do not share your identity with the claimant unless a court orders us to.
8. False notices
8.1Do not send a notice you know is false or misleading. We may close the account of anyone who does, and the sender may be liable for any harm caused.
9. Trademarks and counterfeit goods
9.1To report counterfeit goods or another trademark problem, write to privacy@biddingfever.com with the listing's web address and an explanation. We review these reports under our Terms of Use.
