1. Scope
1.1These Seller Terms apply to every business or person that lists lots or runs auctions on Bidding Fever (the "seller", "you"), and to each team member who acts for a seller. They add to the Terms of Use.
1.2The person who accepts these terms for a business confirms that they have the authority to bind it.
1.3You are the seller of every lot you list and are responsible to buyers for it. We provide the platform, process buyer payments for your auctions through Stripe Connect, and run a claims process.
2. Approval
2.1We review every seller account before it can publish auctions. We may ask for your business registration, your GST/HST and QST numbers, identity verification and a Stripe Connect account.
2.2We may refuse an application, or end a seller account under section 9.
3. Plans
3.1Seller plans are billed monthly, in Canadian dollars, before tax:
- Solo: $99 per month, 1 user;
- Team: $145 per month, 2 to 5 users;
- Unlimited: $260 per month, unlimited users.
3.2No plan limits the number of auctions or lots you can run.
3.3There is no free trial. Your first month is billed when you subscribe, except under the founding offer in section 5.
3.4Plan fees are charged in advance each month to the card on file for your seller account. Sales taxes are added where they apply.
3.5If you change plans during a billing period, the difference is prorated for the rest of that period.
3.6The number of active team members on your account cannot be more than your plan allows.
4. Commission and other fees
4.1We charge a flat commission of 2% of the collected hammer price, net of refunds. The hammer price is the winning bid. The buyer's premium, taxes, shipping and other charges are not part of the commission base, and commission on hammer that is refunded is reversed.
4.2For lots the buyer pays through the platform, the commission is deducted from the payment before it is paid out to you.
4.3For sales the buyer pays outside the platform, such as cash or Interac e-Transfer, the commission is invoiced monthly and charged to the card on file for your seller account.
4.4There are no per-bid fees, no listing fees and no per-lot or per-auction fees.
4.5Card authentication is optional and off unless you turn it on for an auction. When it is on, each authentication of a bidder's card costs $1, up to a maximum of $50 per auction. These charges are billed to you, the seller, once a month.
4.6Stripe's processing fees on buyer payments for your auctions are your cost and are deducted from your payouts.
4.7Monthly usage invoices, for card authentication and for commission on sales paid outside the platform, are charged automatically to your default card. By accepting these Seller Terms you authorize these variable monthly charges. Each invoice is emailed to you and shows how the amount was calculated.
5. Founding offer for the first sellers
5.1The first 5 sellers that we approve and that subscribe under the founding offer receive, on any plan:
- 3 months free;
- then 25% off the plan price from month 4 to the end of month 12;
- then 10% off the plan price for as long as the subscription stays active.
5.2Months are counted from the start of your subscription.
5.3The 2% commission and any card authentication charges apply in every month, including the free months.
5.4Places are given in the order approved sellers subscribe. When all 5 places are taken, the offer ends. A place cannot be transferred.
5.5Cancelling your plan ends the founding offer permanently. It does not come back if you subscribe again.
6. Cancellation
6.1You can cancel your plan at any time from Settings. Cancellation takes effect at the end of your current paid billing period, and you keep access until then.
6.2We do not refund the unused part of a billing period.
6.3At the end of the period your seller account is deactivated and you can no longer publish auctions. Invoices already issued, to you or to your buyers, remain payable.
6.4Before the period ends, finish or close any auction that is still open. Your obligations for auctions that have closed, including invoicing, pickup, claims and refunds, continue after deactivation.
7. Listings and auction conduct
7.1Describe every lot accurately and completely, including material defects, missing parts and repairs, and say when a lot is sold as-is. Photos must show the actual lot. Assign condition grades in good faith, following our condition grade guide.
7.2You must own each lot, or have the authority to sell it, and it must be lawful to sell. You may not list stolen or counterfeit goods, hazardous materials, items that infringe intellectual property, items that federal or provincial law prohibits, or weapons or firearms unless the required licences have been confirmed.
7.3The auction terms you set, such as buyer's premium, deposits, payment deadline, pickup and shipping, must be lawful, be shown before bidding starts and not conflict with the Bidder Terms.
7.4You and anyone connected with you must not bid on your own lots, directly or through others, or arrange bids to raise the price. Shill bidding leads to immediate termination and may be reported to the authorities.
7.5You may set a reserve price before a lot opens. You must not raise a reserve after bidding has started on that lot.
7.6When you sell to buyers in Quebec, provide in French the information the Charter of the French Language requires. Our listing tools let you enter French titles and descriptions.
8. Buyers, payouts and taxes
8.1You receive the contact and shipping details of winning bidders only to invoice them, fulfil their purchases, handle claims and keep the records the law requires. You may not use them for marketing unless the buyer has separately consented under Canada's anti-spam law. Keep them secure, delete them when you no longer need them, and tell us promptly of any confidentiality incident involving them. For that information you are an organization responsible under privacy law.
8.2Buyer payments are paid out to your Stripe Connect account, less the commission and processing fees. We may hold a payout during the claim window, normally 7 days after payment, while a claim is open, or during a fraud review, and we may adjust it for refunds or chargebacks.
8.3When a claim is resolved in the buyer's favour, the refund is taken from your Stripe balance or your future payouts.
8.4You are responsible for determining, collecting and remitting the sales taxes on your sales and for your own income taxes. Our tax settings help calculate the amounts shown to buyers, but they are not tax advice.
8.5Respond to every claim within 5 business days (3 business days during your first 90 days). If you do not respond, the claim may be escalated and decided on the evidence available.
9. Suspension and termination
9.1We may stop you from publishing, hold payouts or close your seller account for a breach of these terms, shill bidding, repeated valid claims, misrepresentation, unpaid fees, legal risk or a failed verification. Where we can do so safely and lawfully, we give you notice and the reason.
9.2If a plan or usage invoice stays unpaid, we may restrict your seller account until it is paid.
10. Responsibility between you and us
10.1You are responsible for your lots, your listings, your auction terms and your dealings with buyers. To the extent the law allows, you agree to cover our reasonable losses from claims by buyers or others that arise from your lots or from your breach of these terms.
10.2To the extent the law allows, our total liability to you is limited to the fees you paid to us in the 12 months before the claim.
11. Changes to prices and terms
11.1We give you at least 30 days' notice by email before we raise a plan price, the commission or a fee. The change applies from your first billing period after the notice period ends. You can cancel before it takes effect.
11.2Other changes to these Seller Terms follow the change rules in the Terms of Use.
